1. Introduction
These terms and conditions ("Terms") govern your use of the Kryptify website, services, and software ("Service"). By accessing or using the Service, you ("User") agree to these Terms. If you represent an organisation, you confirm that you have the authority to bind that organisation to these Terms.
2. Definitions
- "Service": Refers to the encrypted file storage, sharing, and related services provided by Kryptify.
- "User" or "You": Means any individual or entity that accesses or uses the Service.
- "Content": Refers to any data, files, or materials you submit, upload, store, or share using the Service.
- "Controller": The entity that determines the purposes and means of processing Personal Data.
- "Processor": The entity that processes Personal Data on behalf of the Controller.
- "Subprocessors": Third-party entities engaged by Kryptify to process Personal Data on your behalf.
3. Data protection and privacy
- Kryptify processes personal data in compliance with the UK GDPR and Data Protection Act 2018. We are committed to protecting your data and ensuring transparency in our processing practices.
- For clients who require a Data Processing Agreement (DPA) to meet their legal obligations as data controllers, a DPA is available upon request. Please contact [email protected] to obtain a copy.
- We do not sell your personal data. Data is shared only with selected subprocessors for legitimate purposes necessary to deliver the Service.
4. Use of service
- Kryptify grants you a non-exclusive, non-transferable licence to use the Service for lawful purposes in accordance with these Terms.
- You must not misuse the Service, including uploading malicious files, attempting to bypass security measures, or violating intellectual property rights.
- You are responsible for maintaining the confidentiality of your account credentials and any activity that occurs under your account.
5. User conduct
- You agree to use the Service only for lawful purposes and in compliance with these Terms.
- You must not upload content that is illegal, harmful, or infringes on the rights of others.

6. Subprocessors
We engage trusted subprocessors to deliver the Service, including:
- AWS: Provides hosting and secure storage infrastructure.
- Sentry: Enables error tracking and debugging to improve service reliability.
- Mailgun: Sends transactional emails such as account confirmations and notifications.
All subprocessors are contractually bound to comply with data protection laws and maintain the security and confidentiality of your data.
7. Intellectual property
- The Service and all associated intellectual property rights belong to Kryptify or its licensors.
- Users retain ownership of any content they upload but grant Kryptify a licence to use it solely for providing the Service.
8. Disclaimer of warranties
The Service is provided "as is" without warranties of any kind, express or implied. Kryptify does not guarantee that the Service will be uninterrupted or error-free.
9. Limitation of liability
- To the fullest extent permitted by law, Kryptify's liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
- Kryptify is not liable for indirect, incidental, or consequential damages, including loss of data or profits.
10. Indemnification
You agree to indemnify and hold Kryptify harmless from any claims or damages arising from your breach of these Terms or misuse of the Service.
11. Termination
- Kryptify reserves the right to suspend or terminate your access to the Service for violations of these Terms or legal requirements.
- You may terminate your use of the Service at any time by deleting your account. Upon termination, we will delete or anonymise your data as outlined in our Privacy Notice.
12. Governing law
- These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
- Any disputes arising from these Terms will be resolved in the courts of England and Wales.
13. Changes to terms
Kryptify may update these Terms periodically. Any changes will be communicated via the Service or email. Continued use constitutes agreement to the updated Terms.
